“You raised a question, (previously) to me. Whether a person should or should not get an attorney? What creates that pivot point, where I’m not going to get an attorney here, but I will get an attorney here?”

Andrew Dósa – Personal Injury Attorney – Alameda County, CA

“Right. Well, it’s not always possible to determine at the very outset whether a case really would justify hiring an attorney. If the person has an injury, but all they really need is to go to their doctor and make sure there’s nothing serious, and they’re going to be sore for a couple of days, an attorney is probably not necessary. Economically, it might not be worth an attorney’s time to also help someone who only had one to two doctor’s visits. But it’s important for them to make sure they get checked out so there’s nothing hidden or surprise from their medical condition that crops up a little bit later.

As far as getting an attorney, it’s always nice for them to have an understanding about what’s involved in the process, but again, if there’s not an urgent need…let’s back up. If there’s not enough of an urgent need for treatment because the injury’s not great, then there may not be a need for an attorney, and they can handle it on their own. Or, maybe just dealing with their own insurance company, which might deal with the other company, and handle things like property damage claims.”
