“You mentioned a two-year statute of limitations for the client to be able to bring the lawsuit, but another question most people ask is how long will this case take?”

Andrew Dósa – Personal Injury Attorney – Alameda County, CA

“Well, if we had to get into litigation, then my general experience is between 9 to 15 months of litigation will happen before we can get a settlement. Because insurance companies are often unrealistic, I have contemplated simply filing lawsuits very early on, thinking that if I was going to do that and it still was going to take another 9-15 months, why would I want to wait for the client to finish all the treatment, get all the records, submit it to the insurance company, and then have the insurance company reject the reasonable demand or reasonable expectation.”

“And then the 9 to 15 months start…”

“And then we’d have to file a lawsuit and then we’d do the extra time in litigation.”

“So, what do you do? Do you wait?”

Andrew Dósa – Personal Injury Attorney – Alameda County, CA

“Generally, I wait because most of the time clients have simpler claims. If the cases are truly that simple, then there’s just no economic incentive to spending a lot of money in litigation. So, we can try to settle it beforehand. I mean it would be nice to do that, it would be nice if the insurance companies more reasonably responded to our demands for our clients.”
