So, here’s my next question. New York has something called no-fault insurance, and people may not understand that. Can you explain that?
Steven Gacovino – Personal Injury Attorney – Suffolk County (Long Island), New York
Of course. So, when you get an insurance policy, or if you’re a passenger in somebody’s car that’s an insured vehicle in New York, baked into that policy by way of law, is the right to get your medical covered up to the amount of $50,000 or whenever the insurance company cuts you off via an independent medical examination.
But through there, you can also get some travel expenses back and even some lost wages through what we call first-party insurance. So, this comes to somebody regardless of the issue of fault. So, if I’m driving a car and I get into a car accident, it has to do with use and operation of a motor vehicle.
So even if I drove myself accidentally into a telephone pole, I’m going to be covered for medical to a certain extent for my injuries suffered and even lost wages to a certain extent until such time that the insurance company cuts you off, which they do through an independent medical examination. They may look at you and say, “You’re okay now. You don’t need any further treatment.
But up until that point, you are most certainly covered, so long as you’ve done everything the right way and you’ve filed in a timely manner.
