“Ray Hrdlicka. Bail Bond Cowboys. Now we’ve got another question that you might have, in the bail bond process, about the bail bond process. Let me pose it this way. A Mom gives us a call and says, ‘hey, they say my son has been dealing drugs. Now he’s in jail, and now there’s something called a 1275 hold on him. What does that mean?’

Well, what that means is that we, as a bondsman, as a bail bondsman, Bail Bond Cowboys here, we’re going to have to prove, go into the court, have a court date, court hearing, and prove to the court that the money that you pay us, and if collateral is required, if the collateral that is provided to secure the bond is not from the ‘ill-gotten gains’ from dealing drugs. So, how do we do that?

Well, are you working? It comes from your income. It comes from your relative’s income. It comes from savings. Comes from stock. Comes from an equity line from the house. Comes from a number of different areas. We need to be able to show that it didn’t come from the efforts of your son in the drug business.

And the collateral, the same thing. How long have you owned the house? If it’s just your signature, not a problem. Nobody’s going to, obviously, look at that twice. Let’s say it quite a large bond and we need some collateral. So we look at your house. How long have you owned the house? Did you buy it within the last couple of years when he supposedly was involved in this situation? Or have you owned it for 10 years? So, what about other family or friends? Their homes. Same thing. We will be able to put together a situation where we can go to the court and say, ‘here Judge, this is where we’re getting paid, this is where the collateral is coming from, it’s nothing to do with the defendant’s activities. We satisfied the 1275 hold, it’s lifted, we can bail the person out.
