What Happens If He Misses A Court Date?

Ray Hrdlicka – Bail Agent – Bail Bond Cowboys

“Hi, this is Ray Hrdlicka with Bail Bond Cowboys.  The question that you may be asking yourself is…’what happens if he misses a court date?’  If you’re the cosigner, that a pretty damn good question.  But if you’re the defendant, then you’ve probably got the same question.  Does the world end? And the answer?  Absolutely not!  It’s very important that you call us, so we can help you get everything back on track.  Because here’s what’s going to happen.  When you miss a court date, for whatever reason…we’ll get into that in a second here…the judge is going to issue a bench warrant.  You don’t want that, you don’t want to be driving along the street, and all of a sudden you get stopped for some sort of traffic violation.  Guess what?  You are rolled up!  Again!  You don’t want that to happen.

So, the warrant is issued if you miss a court date and the bail is forfeited.  The court is going to contact me, and I am going to contact you, and we’re going to get it back on track.  It’s as simple as going down to the courthouse, getting a new court date.  The court will give it to us.  Then, I give you a “Reassumption of Liability” motion, and that tells the court…let’s reinstate the bail, let’s get everything back on track, and let the court case just proceed as it was originally.

There’s not an issue with that process, the world does not end.  You don’t owe all the money.  That’s a misconception that many people have…’Oh my God, if he misses a court date, then he owes the whole amount of the bail’.  No!  Not at all.  You’ve got six months, actually, to solve the problem.  In California, it’s six months before the court is going to say ‘Ray, pay me the money’.  Then I am going to turn around and say the same thing to you.  But in that six months we can file a motion.  It’s as simple as….we go into the court clerks office in the morning, and more than likely get a court date that afternoon.

So, here’s what we can do.  We can get everything back on track for you easily.  No matter why you missed a court date.  Let’s talk about some of the reasons people miss a court date.  We’ve heard everything.  Truly.  ‘We thought the court date was on Tuesday’, and it was actually on that Monday.  ‘Thought it was at 1:30pm’ and it was actually at 8:30am.  You got car problems, my dog got sick, I got sick, kids are sick, any number of reasons.  None of it matters.  The world doesn’t end.  My point is…take care of your business, call us and we’ll get everything back on track, so you can just keep moving forward.  Again, Ray Hrdlicka with Bail Bond Cowboys.  Give us a call.  Look at the number on the screen, and we’ll help you out.  If you have any other questions, just give us a call anyways.  Good to talk to you.”
