What Happens If My Name Is Not On The Court Calendar At My Court Date?

“Hi, this is Ray Hrdlicka with Bail Bond Cowboys.  Once again, answering your questions about the criminal justice.  A question that we get all the time.  I get you out of jail, I give you your court date, you go to court, and then all of a sudden you call me and say, ‘my name wasn’t on the court calendar.  What’s going on?’

And that answer’s actually very simple.  If you name is not on the court calendar, there’s two things that can occur.  If your name is not on the court calendar, there’s two possibilities.  The first…is that the case has been dismissed.  And hey, that’s great for you.  The DA decided we’re not going to file.  Now, the other possibility, is that there’s no complaint filed…yet.  And that’s the important word.  The District Attorney’s office has a year to be able to file a complaint after an arrest.  An entire year. That’s one of the things that you have to understand when you go to court and you say, ‘hey my name is not on that court calendar.  I’m off the hook.’  Was it case dismissed or was it no complaint filed? Because if it was no complaint filed, you are still on that fence for an entire year.
