Can I Post A Bond On A Warrant While Still In Jail?

“Hi, Ray Hrdlicka with Bail Bond Cowboys. So, a question that we get asked, on a fairly regular basis is, I’m going to use this as an example, ‘hey, my son is serving his sentence in county jail, and now he’s got a warrant in another county. So, what happens when he gets done serving his sentence in the local jail?’ And that’s a very good question. There’s a number of scenarios that can happen.

One…well let’s say you get involved with a bail bondsman, with Bail Bond Cowboys…we post a bond. And the other scenario is we don’t post a bond on that warrant from another county. Let’s talk about both of them.

First one is…we don’t post a bond. Two things can happen. The first is, because there’s a warrant, before they release him from the local county jail where he’s served his sentence, they’re going to run a warrant check. And they’re going to find that warrant from the other county. They’re either going to hold him until that county picks him up, and who know when that’s going to be actually. So, that county’s got to come, pick him up, transport him back to that county. The other thing is…if they don’t pick him up, then your local county jail is going to end up releasing him, even though that warrant is active. The problem is that warrant remains active. So, he’s walking down the street, he gets stopped by an officer, something happens. He’s driving in a car, traffic stop, that warrant is there, he’s going to get arrested again. If they don’t pick him up, they end up releasing him, it’s the same thing again. Now, after a while, they’re going to transport him back to that county. Okay, so that warrant is not going to go away. You’re going to have to deal with it.

So the best way to do that is allow us to post the bond, post bail, on that warrant, while he’s serving, finishing…serving his time here in the local county.

So what happens…is…what happens is we’re going to be able to post a bond on that…actually, we’re going to have to post a bond close to when he gets released, because then he will be given a court date, a court date for that new county. And then he’s going to go appear in court. So, let’s say he’s going to get released in a week. We post a bond on the out-of-county warrant. We’re going to have a court date 30 days down the road. So now he’s got to travel to that county, he’s got to appear in court. But that’s the whole purpose of bailing out with a bail bondsman. You don’t have to stay in jail. That’s a much better scenario, there’s not going to be a warrant for his arrest. He’s going to be able to get out of jail, resume his life, and then go to that court date in that other county. So, that’s the answer to that question.
