What Is The Difference Between No Complaint Filed And Case Dismissed On My Court Case?

“Hi, Ray Hrdlicka, Bail Bond Cowboys.  Once again, the question that you may have is, ‘what is the difference between a no-complaint filed…when I go to court, something happened.  I wasn’t on the court calendar.  So, what’s going on?’

 There’s two possibilities.  No-Complaint filed or the case is dismissed.  We’ve seen them both.  We’ve seen them both hundreds and hundreds of times.  The difference between the two is one is great for you…that the District Attorney has decided, ‘I am not going to file, and we are dismissing the case.’ If that’s that case, the bond is exonerated, and you don’t have to worry about the case at all.  The other side of the coin is that if you’re not on the court calendar, and we find out, you give us a call, we’ll call the court to find out for you, and we find out that there’s no complaint filed.  If that’s the case, the District Attorney has one year, and entire 365 days from the date of the incident, the crime, the arrest…if it happens in the same day…the date of the crime…the District Attorney has one year from the date of the crime to file the complaint.

Now, realistically, the District Attorney is very, very busy.  Your file is going to go on a stack on an Assistant District Attorney’s desk.  Next week, he’s going to get a bunch more files in the same stack.  And the next week, more files.  What I tell you, all the time, is that the longer this goes on, the better it is for your case.  That the District Attorney’s not going to file.  If it goes on three, four, six months, nine months, it’s that much better for you…that he’s not going to file.  They might be looking at witnesses, they might be talking to other people.
